After a death, someone has to gather the person’s property, pay valid debts and transfer what is left to the right people. In Texas, that process usually runs through probate. In Smith County, probate cases are filed with the County Clerk in Tyler and heard by the county’s court with probate jurisdiction.
Filing the Application
The process starts with an application to probate the will, along with the original will. Texas generally requires a will to be offered for probate within four years of death. A hearing is scheduled after a notice period.
Independent Administration
Most Texas estates use independent administration, which lets the executor handle the estate with limited court supervision once appointed. The executor receives letters testamentary, which banks and other institutions rely on.
Muniment of Title
When there are no unpaid debts other than those secured by real estate, the court may admit the will as a muniment of title. That transfers property without appointing an executor and is often faster and less expensive.
The Executor’s Duties
- Notify beneficiaries and publish notice to creditors
- File an inventory or an affidavit in lieu of inventory
- Collect assets and pay valid claims and taxes
- Distribute property to the beneficiaries
When There Is No Will
If someone dies without a will, Texas law decides who inherits, and the process may require a determination of heirship. This is one of the best reasons to have a plan in place. See do you need a will or a trust in Texas.
