Whether you are opening a storefront near Broadway Square, leasing office space off Loop 323 or renting a warehouse in north Tyler, the lease will likely be one of your largest obligations. Commercial leases are negotiable, and Texas law gives tenants fewer default protections than residential tenants get.
Understand the Full Cost
Base rent is only the start. Many leases add a share of property taxes, insurance and common area maintenance (CAM). Ask for a history of these charges, a cap on annual increases, and the right to audit the landlord’s calculations.
Repairs and Maintenance
Who fixes the roof, the HVAC system and the parking lot? In many Texas leases, tenants take on more repair responsibility than they expect. Get the division of repair duties in writing, and consider asking the landlord to warrant that major systems work on the day you move in.
Use, Buildout and Permits
Make sure the permitted use clause covers your business and anything you might add later. If you need buildout, spell out the tenant improvement allowance and who manages construction. Confirm zoning and City of Tyler permit requirements before you sign.
Assignment, Subletting and Exit
If you sell your business, can the buyer take over the lease? Negotiate the right to assign to a buyer of the business without unreasonable landlord interference, and look for early termination or renewal options that match your plans.
Personal Guarantees
Landlords often ask owners of small businesses to guarantee the lease personally. Try to limit the guarantee to a set dollar amount or time period, or have it fall away after a period of on-time payments.

Frequently Asked Questions
Can I negotiate a commercial lease in Tyler?
Yes. Rent, allowances, repair duties, renewal options and guarantees are commonly negotiated, especially in longer terms.
What happens if I need to close before my lease ends?
It depends on your lease. Without an early termination or assignment right, you may remain liable for rent, though Texas law requires landlords to try to mitigate damages.
